Greetings and brachos*,

I reply to your letter of 3 Shevat, by which you tell me that your doctor recommends an operation for your wife:

A) to redo the sutures of the previous operation that have come undone,

B) to lift and put back in their place the genital organs.

In my opinion, this proposal can be accepted, on the condition that a second doctor, specialist in the matter, also subscribes to it.

A third proposal is also formulated. This doctor proposes, in the course of the same operation:

C) to suture and ligate the tubes.

It does not seem to me that this is a good thing. You will solicit the advice of an Orthodox rav* who will indicate to you the halachah* in the matter and will tell you whether this is permitted. Your words, which are very concise, seem to indicate that after this ligation, your wife will no longer be able to have children. Why must you come to that?

You say that the doctors explain your wife's weakness by the frequency of her pregnancies and births, until now. Now,

A) they may be wrong about that, and perhaps her state is bound to her diet, the modification of which, like that of her way of life, will permit her to recover her strength.

B) Even were it to prove that it would be dangerous for her to be pregnant, in the present circumstances, the responsa Tzemach Tzedek, Even HaEzer, chapter 89, permits, in such a case, the use of contraceptives[1]. To know which to use, you will consult an Orthodox rav.

I am enclosing for you a copy of my letter[2], addressed to all, on the occasion of the chassidishe* farbrengen* of "the yom tov of all yamim tovim," 19 Kislev, as well as the customs[3] for the day of the hilula* of my father-in-law, the Rebbe[4].

May Hashem grant that there be fulfilled the promise according to which "those who repose under the earth will awaken and rejoice." And he will be among them, very soon and truly in our days.

במענה על מכתבו מב' שבט, בו כותב אשר הרופא שלהם מציע לזוגתו תחי' לעשות נתוח א) לאחד את התפירות מנתוח הקודם שנתפרדו, ב) להרים ולהעמיד את האם במקומה:

לדעתי נכון הדבר ובלבד שיסכים ע"ז עוד רופא מומחה במקצוע זה.

ובנוגע להצעה השלישית, שבב"א עם נתוח הנ"ל מציע ג"כ הרופא ג) לתפור ולסתום את צנור מקור ההריון:

אין נראה לי הדבר, ויתייעץ עם רב חרדי בהנוגע להדין בזה, ואם גם מותר יהי' ע"פ דין, הרי כנראה מדבריו הקצרים, ע"י תפירה כזו ישללו מזוגתו תחי' את האפשרי[ו] ת להתעבר עוד, ולמה להם לעשות את זה,

ומ"ש שהרופאים תולים סיבת חלישות זוגתו תחי' בתכיפות העבור והלידה שעד עתה, הנה הרי אפשר א) שטועים הם בזה, ואין הדבר תלוי אלא באכילה ושתי' כדבעי והנהגת סדר החיים באופן שתחזור לאיתנה, ב) גם אם יתברר שסכנה לה ח"ו עתה להתעבר במצב בריאותה, יעויין בשו"ת צמח צדק חלק אבן העזר סי' פ"ט אשר במצב כזה מתיר לשמש במוך, וע"ד האופנים בזה יתייעץ עם רב חרדי.

מוסג"פ העתק מכ' הכללי בקשר עם התועדות דחג החגים י"ט כסלו, וכן מנהגי ההילולא של כ"ק מו"ח אדמו"ר זצוקללה"ה נבג"מ זי"ע והשי"ת יזכנו לקיום היעוד הקיצו ורננו שוכני עפר והוא בתוכם במהרה בימינו ממש.
