Greetings and blessings,

You raise in your letter the mechitzah*[1] in the shul*[2]. An article on this subject was published, some time ago, in the periodical HaMaor, which appeared in Brooklyn, in Teves 5711[3]. The author, Rav Avraham Winfeld of New York, cites the Rambam*, in the eighth chapter of the Hilchos Lulav*, in the fifth chapter of the Hilchos Beis HaBechirah*, and in the commentary on the Mishnah*, in tractate Sukkah*, as well as the Tosafos Yom Tov*.

These latter texts say that this mechitzah* must be such that one cannot see[4]. The author also cites the responsa of the Maharam Shik*, Orach Chaim part, ch. 77. He protested vehemently against those who wished to constitute this mechitzah* with columns, in which case it is possible to see.

He concludes by stressing that it is the same when the women have their hair covered and no part of their body is uncovered[5]. How much more so is this the case if their hair is uncovered and their arms bare. The prohibition is then doubled. You will consult, on this subject, Orach Chaim, ch. 75. This is self-evident.

In the issue of Iyar-Sivan 5713 of this same periodical, this subject is raised once again.

במה שהעיר במכתבו אודות מחיצה בבית הכנסת, הנה זה מכבר נדפס מאמר בזה בהירחון "המאור" המופיע בברוקלין, טבת תשי"א, מהרב אברהם שי' וויינפעלד דנויארק ומעיר שם מהרמב"ם פרק ח' הלכות לולב, מהלכות בית הבחירה פרק ה', פירוש המשניות בסוכה ובתוס' יו"ט, שבמקומות האחרונים משמע שצריכה להיות המחיצה באופן שלא יוכלו להסתכל ומציין ג"כ לשו"ת מהר"ם שיק חלק או"ח סי' ע"ז שהרעיש עולם נגד הרוצים לעשות מחיצה בעמודים באופן שיוכלו לראות, וסיים שפשוט הדבר שכל זה נאמר אפילו אם כל הנשים נזהרין בכיסוי ראש ובטפח מגולה, מכש"כ עאכו"כ אם הן הולכות פרועות ראש וזרועות מגולות, יש איסור כפול, ועיין באו"ח סי' ע"ה וזה פשוט. ובירחון הנ"ל דחדש אייר-סיון תשי"ג מדובר ג"כ בהנ"ל.
