I greet you and bless you,

It was with pleasure that I received your letter in its time, together with what it contained — responsa* concerning the status of persons dependent upon a plaintiff. As you request, these are being returned to you.

You mentioned in your responsa* the Talmudic and Halachic* authorities' references treating this question. In my view, the essential point is the following: the judges must, to the fullest extent possible, endeavor to establish whether the risk of the plaintiff withdrawing is real or merely illusory.

Indeed, a judge is obligated to render a rigorously exact verdict, and our Sages rule in Tractate Shevuos* 30b — as cited by the Tosafos* in Tractate Bava Basra* 8b — that in the majority of cases, it is based on these elements that the judge will decide whether he must follow the defendant when the latter subsequently claims that the plaintiff has withdrawn.

I enclose what was published on the occasion of the Hilulah* of my father-in-law, the Rebbe, this 10 Shevat. It will surely interest you.

בעתו נעם לי לקבל מכתבו עם המוסגר בו שו"ת בדיני נזקקין לתובע אשר כבקשתו מוחזר בזה. וכבר הראה כת"ר בתשובתו בש"ס ופוסקים המדברים בכגון דא, ולדעתי נקודה העיקרית בזההיא שעל הדיינים לברר עד כמה שידם מגעת אם החשש שישתמט התובע וכו' אמת הוא או מרומה, כי מחובתו של הדיין לדין דין אמת לאמיתו, וכמרז"ל שבועות ל' ע"ב הובא ג"כ בתוספת ד"ה דין ב"ב ח' ע"ב לפסק הלכה אשר ברובא דרובא עפ"ז יש להדיין להחליט אם למלאות תביעת הנתבע כשטוען שהתובע ישתמט אח"כ.

מוסג"פ מה שהו"ל בקשר עם יום ההילולא של כ"ק מו"ח אדמו"ר זצוקללה"ה נבג"מ זי"ע יו"ד שבט העבר, ובטח יעניין את כת"ר שי'.
