I greet you and bless you,

You tell me that some people among those of Yemenite origin are preventing you from organizing Mesibos Shabbos* (Shabbos afternoon recreational gatherings for children) for boys and girls. They consider, indeed, that such a practice is forbidden on Shabbos*, but you do not specify for what reasons.

Perhaps it is because of singing and dancing (which might lead to the use of musical instruments), based on the Shulchan Aruch* Orach Chaim, Chapter 339, paragraph 3. If this is indeed the case, you must approach the Rabbanim* of the Yemenite community and explain to them that the Perushim* (who advocated scrupulous observance of the Mitzvos*) authorized this practice long ago, on account of the joy of the Mitzvah*. Now, a Jewish custom is an integral part of the Torah, and one must take into account what is the common practice.

It is certain that the Sefardim* themselves adopt such a practice on Simchas Torah*, and it seems to me, also on Pesach* at the time of the Seder*. Now, those who avoid all of this do so on Shabbos* and festivals for the same reason. The joy that accompanied the drawing of water in the Beis HaMikdash* (during the intermediate days of Sukkos*) is, however, different, as the Tosafos* state in Tractate Sukkah 50b.

You should explain to them that these Mesibos Shabbos* were instituted by my father-in-law, the Rebbe, whose merit protects us — a leader of Israel. And one finds a lengthy explanation of the permission granted in this matter in the Responsa Minchas Elazar, Volume 1, Chapter 29, and the end of Volume 2, Chapter 36 — including according to the opinion of the Beis Yosef* (upon which the Sefardim* base themselves).

When their Rabbanim* authorize the Mesibos Shabbos*, these will surely be strengthened thereby. In our times, there is no reason to set in opposition the Beis Yosef* and the Rema* (upon which the Ashkenazim* base themselves). You should consult the Shulchan Aruch* and its commentators, Orach Chaim, Chapter 339, paragraph 3. There is therefore no difference in this matter between Ashkenazim* and Sefardim*.

I hope that all of this will be resolved at the soonest, so that you will not be suspected of imposing Ashkenazi customs upon Sefardim* of Yemenite origin.

... מ"ש שאחדים מהתימנים מפריעים בידם לערוך מסיבות שבת לילדים וילדות, כי לדעתם זהו אסור בשבת, ואינו מבאר טעמם בזה. ואפשר הטעם הוא מפני השירה והרקוד אז, ע"פ שו"ע או"ח סי' שלט ס"ג. ואם כן הוא - הי' עליו להתדבר עם הרבנים דהתימנים ולבאר להם, שזה מכבר התירו פרושים את הדבר בשמחה של מצוה. ומנהג ישראל תורה היא. ותא חזי מאי עמא דבר. ואפילו הספרדים עצמם, בטח נוהגים כן בשמחת תורה, וכמדומה לי גם בפסח בשעת הסדר, והרי טעם הנמנעים בכל הנ"ל אחד הוא בשבת ויו"ט כו' [ושאני שמחת בית השואבה במקדש, וכמ"ש בתוס' ד"ה רבנן (סוכה נ' ע"ב)]. ויסביר להם שהענין דמסיבת שבת נתייסד ע"י כ"ק מו"ח אדמו"ר זצוקללה"ה נבג"מ זי"ע נשיא ישראל. והאריך בההיתר בזה בשו"ת מנחת אלעזר חלק א' סי' כ"ט ובסוף חלק השני לו ואפילו לדעת הב"י. וכשיתירו הרבנים שלהם את הענין הרי בטח יתוסף עי"ז בהמסיבות שבת ובזמ"ז אין לעשות פלוגתא בין הבית יוסף והרמ"א, (יעויין בשו"ע ובנ"כ או"ח סי' של"ט סעיף ג') ובמילא אין גם חילוק בין אשכנזים לספרדים.

ותקותי שיסדר הדבר בהקדם, כדי שלא יחשדו אותם שרוצים לכוף את בני התימנים הספרדים במנהגי האשכנזים...
