Greetings and blessings,

You ask me regarding the commentary of the Perishah* on the Tur Choshen Mishpat*, chapter 389, paragraph 3 (relating to damages caused by an animal belonging to a person), concerning the expression "the lion attacks and eats." The Perishah specifies that the novel element in this phrase is the assertion that it "attacks." It is, by contrast, established that it "eats." Yet, according to you, the opposite would seem more logical.

It is true that one could deduce from a commentary of Rashi* on Tractate Bava Kama 16b that the act of eating is indeed the novel element. Nevertheless, such an interpretation is untenable, for the Gemara* specifies that "he changed his mind and ate it." Now, if the act of eating were the novel element, what need would there be to specify that he changed his mind?

And this explanation accords with the view of the Perishah, for the lion "attacks" its prey in order to place them in lairs and hiding places. Then it "eats" them subsequently, already dead. By contrast, when it is hungry, it does not wait for them to die, for it is the king of animals, as the Perishah specifies. Conversely, if one sees it reject its prey, one may think that it is thereby acting contrary to its nature.

The Shiltei HaGibborim* is of the same opinion as the Perishah.

...מה שהקשה על הפרישה לטחו"מ סשפ"ט סק"ג דמפרש דארי שטרף ואכל השינוי הוא בזה שטרף, אבל האכילה אח"כ אורחי' הוא - ולדידי' איפכא מסתברא.

הנה אף דמלשון רש"י (ב"ק טז, ב ד"ה והכתיב) משמע קצת דהשינוי הוא בהאכילה, ע"כ אאפ " ל כן מדמשני שם בש"ס בשנמלכה ואכלה ואם השינוי באכילה מאי מהני הא שנמלכה.

וגם הסברא הוא כדעת הפרישה, כי הרי ארי טורף בשביל חוריו ומעונותיו ואוכלם אח"כ - היינו נבלות, אלא שבשעה שרעב אינו מחכה עד שתמות כי הוא מלך בחיות כו' וכמ"ש בפרישה ואם רואים שמכחה ה"ז היפך אורחי'.

גם בשה"ג כתב כהפרישה.
