To the distinguished chassid who fears Hashem and whose accomplishments are many,

I greet and bless you,

You tell me that you were asked about the chassidic discourse* entitled 'When ten persons are seated,' delivered in 5688. It states therein that the divine Name El* is the first of the thirteen Attributes of Divine Mercy*. Yet the Tosafot* in tractate Rosh Hashana 17b hold that it begins with the first Name Havayah* or with the second.

There are four ways to count the beginning of these thirteen Attributes, as the Korban Netanel* indicates at the end of the first chapter of tractate Rosh Hashana. You should also consult the Be'chayeh* on Parshat Ki Tissa*:

* from the first Havayah — according to the Pesikta Rabbati*, Midrash Shocher Tov* 93, the Chachmei Tzarfat* cited by the Abudraham* at the end of tractate Ta'anit, presumably representing the view of Rabbenu Tam*, Rabbi Avraham ibn Ezra* on the Torah and the Rosh*;

* from the second Havayah — according to the Ranag* on the Tosafot, a Gaon* who appears to be Rabbi Saadya Gaon*, cited by Rabbi Avraham ibn Ezra, and seemingly according to one of the interpretations of Sefer HaLikutim* of the Ari Zal* on Parshat Ki Tissa;

* from the Name El — according to the Zohar*, vol. 3, p. 131b; Etz Chaim*, Sha'ar Arikh Anpin*, chapter 11; Peri Etz Chaim*, Sha'ar HaSelichot*, chapter 4; Sha'ar HaKavanot*; Mishnat Chassidim* and other texts. One may ask why the Derech Emet*, commenting on the Zohar, adopts the first view. If I may venture an opinion, it seems to me that this explanation cannot be that of Rabbi Chaim Vital*, since it contradicts the writings of the Ari Zal. It is also said that due to a printing error, passages from the Imrei Binah* were introduced into the Derech Emet;

* from the term Rachum* ['merciful'] — according to Sefer Chassidim*, chapter 250, and the Maharal* of Prague in his Netivot Olam*, who says he bases himself on Zohar vol. 3 cited above and on the Talmud — though I confess I do not understand this, for those references support the view of the Ari Zal.

For all matters pertaining to the esoteric dimension of Torah*, the view to be followed is that of Kabbalah*, whose sages were aware of the opinion of Tosafot and the Ranag and therefore ruled accordingly. Furthermore, Rav Azulai*, commenting on Sefer Chassidim, says: 'Our master and Tosafot counted the Attributes of Divine Mercy in this way because in their era the Zohar had not yet spread. This book, together with the writings of the Ari Zal, reveals their count and their content.'

If one takes the revealed dimension of Torah as the reference, everything depends on which version of the Talmud one follows. According to the version of the Rif* and the Rosh, one can understand that the beginning of these Attributes is the Name Havayah. Moreover, the particular connection between the Rosh and the masters of Tosafot is known — one of the greatest being Rabbenu Tam. The connection between the Rif and the Geonim* is also known.

On the other hand, according to the most widespread version of the Talmud — the one we possess — the text, before commenting on the thirteen Attributes, clearly cites the words El Rachum*. The same applies to the version of Ein Yaakov*. This is an indubitable proof that El is indeed the beginning of these Attributes. This is what the Maharal and the Etz Yosef* say, while the Dikdukei Soferim* does not note this version.

The Rosh raises a question in this regard. If one does not accept the view of Rabbenu Tam, how is it that the congregation, when reciting aloud the thirteen Attributes of Divine Mercy during Selichot*, does so starting from the Name Havayah?

The answer to this question can be deduced from the writings of the Ari Zal, according to which these two Names Havayah are at the origin of all thirteen Attributes of Divine Mercy. This can be understood from Chassidut*, from Likkutei Torah* and Torah Or*, which also makes it possible to explain the Pesikta and Midrash Shocher Tov in accordance with the view of the Ari Zal.

Simply put, the congregation therefore says: 'You, Havayah, Havayah, we implore You to be El Rachum.'

The Rosh also observes that Notzer chesed la'alafim* ['He preserves kindness for thousands'] should be a single Attribute, but the Tosafot have already addressed this objection.

(6) The Rebbe notes in a footnote: 'Later addendum: The Dorech LeTziyon*, cited by the Bnei Yissaschar*, finds proof in support of the Zohar and the writings of the Ari Zal — that the thirteen Attributes of Divine Mercy begin with El — in the fact that these remain the same whether the Temple is built or not. Yet in the era of the Temple, the Name Havayah was read as it is written. If it were the first of these Attributes, there would therefore be a difference between the two eras.'

הנה ד' שיטות בהתחלת מנין יגמה"ר (הוזכרו בקרבן נתנאל ספ"א דר"ה ועייג"כ ר' בחיי פ' תשא):

שם הוי' הא' (פסיקתא רבתי שוח"ט צ"ג, חכמי צרפת הובאו באבודרהם פי' נעילה דתענית וכנראה הם הם ר"ת בתוס' שם, הראב"ע עה"ת, רא"ש ועוד).

שם הוי' השני (רנ"ג בהגהה לתוס' שם, גאון הובא בראב"ע שם, וע"פ הקדמת הראב"ע לפירושו הוא ר' סעדי' גאון. וכ"מ קצת לפי' אחד בספר הלקוטים להאריז"ל פ' כי תשא).

א-ל (זח"ג קלא, ב. ע"ח שער א"א פי"א. פע"ח שער הסליחות פ"ד. שער הכוונות דרושי ויעבור דרוש ג' ואילך. משנת חסידים מסכת שארית האצילות פ"י ואילך. ועוד.

וההחלטה המקובלת בעניני סתרי תורה היא ע"פ חכמי הקבלה*. ובפרט שהם ראו גם את דברי התוס' ורנ"ג וכו'. ובכ"ז החליטו כנ"ל. וכבר כתב האזולאי בפי' לס"ח שם וז"ל: רבינו והתוס' בפ"ק דר"ה חתרו למנות י"ג מדות מפני שבימיהם ז"ל לא נתגלה ספר הזהר הקדוש. ושם ובכתבי רבינו האריז"ל גילו לנו מנינן וסודם. עכ"ל*.

ועפ"י נגלה י"ל דתלוי בהגירסא בש"ס. דהנה גרסת הרי"ף והרא"ש היא דדרשת ר"י שם דברית כרותה ליגמה"ר כו' באה תיכף אחרי הדרשה על הוי' הוי', ולכן אפשר לומר דזהו התחלת יגמה"ר - וידוע ע"ד שייכות הרא"ש ובעלי התוס' אשר ר"ת מראשיהם. וכן ע"ד שייכות הרי"ף והגאונים -

משא"כ להגירסא בש"ס שנתפשטה ונתקבלה אצלנו דהדרשה דברית ליגמה"ר מקדים לה הש"ס התיבות א-ל רחום וכו' (ועייג"כ גירסת הע"י) ה"ז ראי' מכרעת דהתחלת המנין היא א-ל - וכמ"ש המהר"ל שם ראי' זו ובטו"א הובא בעץ יוסף** (ובדקדוקי סופרים לא הביאו שינוי גירסא זו!).

והנה ברא"ש שם הקשה דאם לא כשיטת ר"ת למה פשט המנהג דהצבור כשחוזרין יגמה"ר בקול רם מתחילין מהתיבות הוי' הוי'.

והתירוץ מובן עפמ"ש בכתהאריז"ל שם דשני שמות הוי' אלו הם מקור כל יגמה"ר.

ומובן ע"פ דא"ח עפמ"ש בלקו"ת ד"ה והי' ביום ההוא יתקע פ"ד, ובתו"א מקץ סוף הביאור לד"ה כי אתה נרי (ועפ"ז יש לתרץ בפשיטות הפסיקתא ומד' שוח"ט לדעת האריז"ל). או, אין פשט ווערטער, הצבור אומרים: (אתה) הוי' הוי' (אנו מבקשים שתהי') א-ל רחום גו'.

מה שהקשה שם עוד ברא"ש דנוצר חסד לאלפים צ"ל מדה אחת - כבר מתורץ בתוס' שם.
