I extend great greetings and blessings (see note 1).
I am following up on the telegrams (see note 2) that I sent you. Please excuse me for having sent them as urgent. Indeed, the matter was immediate. Several Jews and Jewesses who fear the Word of Hashem were misled (see note 3). They had been attracted by the assertion that, according to the Chief Rabbinate, it was permitted to travel on these Israeli ships. They were therefore about to board them a few days before Shabbos*. Among them, some questioned me and I responded that it was clear to me, as I will demonstrate below, that the Chief Rabbinate cannot have permitted such travel, and that to verify this, I was sending them these telegrams to obtain clarification.
You can understand the moral satisfaction I felt upon receiving your telegram confirming that this is not accurate and that such permission was never given.
Since we are on this subject, I will specify certain points on which I base my opinion, as I expressed in my telegram. I will not cite references here. There is surely no need to do so, as they are well known to you.
This question is not the same as that posed by the Shulchan Aruch*, the early and later authorities, referencing a ship or a caravan and asking whether a certain person has the right to board it. According to the current situation, the question concerns the ship itself. Is it permitted to travel aboard it, knowing that it will operate during Shabbos, or is this forbidden?
In other words, the halachic* ruling concerns first of all the owners of this ship. Can they organize its movements and voyages so that the machines operate during Shabbos and the journey continues, or is it forbidden to do so, and must they ensure that the voyage stops for the duration of Shabbos — in a port or on the open sea?
As I said, all the analyses made by the early and later authorities concern the traveler's voyage and therefore do not apply to our subject.
The question that arises here is therefore the following: Is the operation of the machines and the navigation of the ship during Shabbos forbidden or not? And if there is a prohibition in this matter, can one consider that this is a case of force majeure? A final point: is it preferable that one act inadvertently (see note 4)? Obviously, this can only be so if no question is asked. Once a question is posed, one can no longer act inadvertently.
Regarding the first point, anyone who has even rudimentary knowledge of ship navigation and machine operation knows that one transgresses, beyond the shadow of a doubt, the Torah prohibitions of kindling fire, cooking, and others. This is inherent to the machines themselves.
Furthermore, several prohibitions are linked to the practices and customs of maritime companies, or to the habits and customs of means of transport in general. Very regularly, and sometimes even several times a day, measurements are taken, and certain results concerning the ship and the voyage are then recorded in certain logbooks; telegrams are sent and received on various points; the ship's direction is corrected; and other things are done. Moreover, for all of this, it is very often necessary to turn electric lighting on and off.
I have learned, on this subject, a particularly curious piece of information. It seems that some, through lack of knowledge, accept that this is so.
It is claimed that ship machines nowadays operate automatically. One can understand what this means, but it in no way applies to our subject. It is true that machines can operate automatically for a certain time, but several times a day they must be lubricated with a certain grease. They must be redirected or readjusted. However, between two adjustments, they do indeed operate automatically.
Moreover, it is not sufficient merely to readjust these machines. Their operation must also be modified and adapted to various external factors that need not be specified here. Now, these adjustments and modifications also include several types of labor defined by the Torah. Every mechanic knows this.
Anyone who claims that one can adjust machines and prepare them before the onset of Shabbos so that their operation is automatic throughout the entire day, without any need for intervention, demonstrates the greatest ignorance in matters of mechanics.
Certainly, thorough research would make it possible to develop a ship whose operation would be entirely automatic — not only for one day but even for an unlimited time. Nevertheless, several years will yet pass before the realization of this project.

Concerning the second point — whether or not this constitutes a case of force majeure for several persons, or at least for one — if the ship is immobilized during Shabbos in a port or even at sea, it is absolutely evident that this situation presents no danger, not only in normal winds but even in exceptional ones.
Indeed, one does not save a ship from a storm by operating its machines. This is done through a particular construction on board, or even sometimes by fleeing the storm. Another essential point must be known: the current era differs from the past. Indeed, a storm can be predicted several hours before it occurs at a given location. There is therefore sufficient time to restart the machines, if they have been shut down previously because of Shabbos.
Another argument is advanced that is no less surprising than the preceding one. It is claimed that stopping a ship on the open sea increases the risk of collision between two vessels. Conversely, this risk is said to be less if the ship is in motion. It is clear that this contradicts the most elementary logic. When a ship advances at a relatively rapid speed, as is the case in our era, it is more difficult to modify its trajectory or to stop it if it suddenly appears that another vessel is approaching. This is not so when the ship is stationary.
Moreover, such a risk is improbable given the organization adopted in our era, according to which all ships at sea report by telegraph to all those they might encounter, in order to avoid collisions. The transmission of this information, as well as the lighthouses on the ships, are the means of preventing such collisions — whereas being in motion makes this more difficult.
In reality, there is no need to elaborate on all of this, and I write these lines only because I have heard, to my surprise, that there are two categories of opinion permitting the operation of machines and the travel of ships during Shabbos, based on two opposing arguments.
The first opinion considers that all human intervention is unnecessary, because throughout the twenty-four hours (see note 5), the ship advances automatically. But the second opinion claims the reverse — that there is danger, or at least a risk of danger, if the machines are not operated by men. Special surveillance is then necessary, because it is very dangerous to stop the ship on the open sea.
Now, even according to this conception, one does not understand why it would not be possible to stop the ship in a port. Along the way, there are numerous islands and ports, in both directions. I emphasize this point because these days a new justification for this permission has begun to be disseminated, which is the following: in six days, ships departing from here do not have time to reach Europe. But they omit to mention that there are numerous ports along the way. Moreover, one can always stop the ship on the open sea.
In light of all this, one can understand that even if no one asked about this subject, one could not claim that it is preferable that one act inadvertently. This is, indeed, a prohibition clearly stated by the Torah — that of kindling fire.
Another point, which is particularly important: if one takes into account that a large number of travelers will conform to the opinion of the spiritual leaders of the Jewish people and will not board a ship that travels during Shabbos, it is almost certain that at least some of the Israeli ships will organize their voyages so that they stop during Shabbos. Now, all of this is justified even if it is done for a single ship.
Obviously, all of this is even more clearly valid for voyages organized by parties that present themselves as religious. If such an instruction is given, they will follow it.

I will add a point that is not directly related to the subject at hand. One may ask whether it is possible to board a ship that will travel in any case. Now, in all the analysis I have been able to see concerning what has been written and printed about Israeli ships, it seems that no attention has been paid to the following points, which are nonetheless fundamental:
It is possible to travel on a ship that is not Israeli. Even if one claims — contrary to the truth — that the principle of "you shall purchase from your fellow" has the force to permit such travel, one can still travel on an Israeli ship without being on board during Shabbos. It suffices to leave the ship before Shabbos and wait for the next Israeli ship, even if the journey is thereby lengthened. This possibility eliminates the distinction that can be made according to whether one begins the journey three days before Shabbos or after that, according to Rabbeinu Chananel*, the Ramban*, the Razah*, and others (see note 6).
Furthermore, one can also travel on an Israeli airplane, which begins and ends its journey during weekdays.
In addition to the question that has been posed, another question concerning ships has been added in these recent generations. The services rendered to travelers are also linked to labors (see note 7) — sometimes even those defined by the Torah — for example, softening water and distributing it to the cabins of travelers by means of machines. The same applies to the lighting of these cabins, as well as to the lighting of the place where one prays.
In this matter, one cannot say that "a candle lit for one person illuminates a hundred," because the majority of travelers are Jewish. The more numerous they are, the more one must increase the number of machines or the hours of labor. You should consult, on this topic, the Kalkalas HaShabbos* of the author of the Tiferes Yisroel*, "labor of Shabbos," chapter 9.
Thus, in the case of genuine danger to the traveler that would consequently permit such travel, the Rav must warn him that shortly after the onset of Shabbos, he can no longer, for example, use the ship's water, nor the light, nor recite Kiddush* over wine (see note 8).
For in general, there is no sick person on a ship, as the ship's logs indicate. Moreover, we have seen that in this matter, one cannot say that "a candle lit for one person illuminates a hundred."
Likewise, it must be emphasized that on large ships, it is inconceivable (see note 9) that during these twenty-four hours there will not be a breakdown of a machine that must be repaired immediately.

In order to consider all arguments, I cite another one that is also circulating, which is the following: the immobilization of a ship and the shutting down of its machines entail a significant financial loss. The means necessary for armament will therefore be lacking. It is, however, clear that one cannot, on the basis of such an argument, wage war against the observance of Shabbos in the factories and fields of the Holy Land. Now, the observance of Shabbos has a financial cost even greater than that of stopping ships during their voyage.
I will add that in this analysis, I have not considered the transgression of the sanctity of Shabbos in the name of a significant portion of the Jewish people. Indeed, it is well known to far more than ten Jews (see note 10) that these ships are considered the property of our entire people, whose name they bear. How much more so regarding the way other nations observe them.
It is difficult to say more, for this is painful and alarming — especially in light of the well-known words of the Ramban, upon which the Chasam Sofer* based himself in his responsa, volume 6, chapter 97, according to which the operation of these Israeli ships could transgress a Torah prohibition even without all of the above. Indeed, there is here, publicly, the greatest breach of Shabbos rest. According to him, this is indeed a Torah prohibition.
You should also consult, among other sources, the Rambam*, Laws of Shabbos, beginning of chapter 21 and end of chapter 24; the Mechilta* of Rabbi Shimon ben Yochai on Vayakhel, chapter 35; the commentary of Rashi* on the Gemara and the Rif*, tractate Beitza 37a.
To the one who fills the breaches of the people of Israel, Hashem sends a spirit of purity, to strengthen the wall of Shabbos — for if the Jews observe it in the fitting manner, they will be immediately redeemed.

בהמשך להמברקים ששלחתי לכהדר"ג שליט"א, ואחרי בקשת סליחתו על שילוחם באופן דחוף, כיון שהשאלה עמדה על הפרק וכמה אנשים ונשים מבני ישראל החרדים לדבר ה' היו במבוכה כי פיתו אותם באמור להם כי ישנו היתר ברור מהרבנות הראשית לנסוע באניות ישראליות אלו ועמדו להפליג כעבור ימים אחדים בערב שבת קדש ההוא.
וכיון שביניהם היו גם כאלה שפנו אלי בשאלה ואמרתי אליהם - על פי הדברים דלהלן - שברור בעיני שאי אפשר הדבר שהרבנות הראשית התירה נסיעה כזו וליתר שאת אפנה אליהם במברק לברר הענין, נאלצתי לשלוח המברקים הנ"ל. ומובן גודל הסיפוק רוחני בהתקבל המברק מכהדר"ג שאין נכון הדבר ולא נתקבל היתר מהם.
ואיידי דאתי לידי, אבוא בזה באיזה נקודות שעליהם מבוססות חוות דעתי כאמור במברקי ולא אביא כאן המראה-מקומות שבודאי אין נצרך לדכוותי' וידועים.
השאלה הנ"ל אינה מסוג השאלה המובאת בשו"ע, בראשונים ובאחרונים, אשר ישנה ספינה (או שיירה) והשאלה היא האם מותר לו לפב"פ להפליג בה כו'. כפי המצב עתה - השאלה היא על עצם הספינה אם מותרת להפליג באופן שתסע גם בשבת, או שאסור לה. במלים אחרות, הפס"ד, לראשונה, הוא בהנוגע לבעלי הספינה אם מותרים הם לסדר זמני הפלגת האני' ונסיעתה באופן שגם ביום השבת תפעלנה המכונות ותמשיך נסיעתה, או שאסור עליהם דבר זה ומוכרחים לסדר זמני נסיעות האני' באופן שביום השבת תפסיק הנסיעה, אם בשביתה בנמל או על ידי העמדתה בלב ים. ועל פי האמור, הרי כל השקו"ט המובאים בראשונים ובאחרונים בשאלת הפלגה בספינה הנ"ל אין כאן מקומם.
ומה שיש לדון בנידון דידן הוא אם הפעלת המכונות והנהגת האני' בשבת יש בזה איסור אם אין, ובאם יש בזה איסור האם יש בזה ענין של פיקוח נפשות, ולאחרונה אם שייך כאן הדין דמוטב שיהיו שוגגין (באם לא היו באים בשאלה מותר או אסור - כי אם שואלים אין מקום לענין דמוטב כו').
ובהנוגע לנקודה הראשונה, מי שיש לו ידיעה, עכ"פ בראשי פרקים, באופן הנהגת אני' והפעלת המכונות, יודע אשר אין כל ספק שיש בזה איסור מן התורה דמבעיר, מבשל, ועוד ועוד, אשר זהו מצד המכונות עצמן. ונוסף על זה יש עוד כמה וכמה איסורים בקשר עם הנוהג וחוקי חברות אניות וחוקי ומנהגי התחבורה בכלל, אשר לעתים תכופות ביותר, כמה וכמה פעמים במשך המעת לעת - מודדים ונכתבים בפנקסים מיוחדים כמה פרטים בהנוגע לנסיעת האני' ועניני', נשלחים מברקים וגם מתקבלים בהנוגע לכמה ענינים הקשורים וגם מכוונים את מהלך האני', ועוד ועוד.
ולהעיר ג"כ אשר חלק מהנ"ל קשור בהדלקות נר (חשמלי) וכיבויו.
שמעתי שמועה הכי מוזרה, אבל מפני אי הבקיאות בדבר כנראה שישנם אנשים שמתקבלת היא אצלם, והיא
שמכונות האניות שבזמננו מתנהלות באופן אווטומאטי. ואף שללשון זה יש הסברה, אבל אין לו כל שייכות לענינינו, שאמת שהמכונות יכולות להתנהל באופן אווטומאטי משך איזה זמן, אבל כמה פעמים ביום מוכרחים למרחם (במין שומן), לכוונם או גם להעריכם מחדש (אלא שבין הערכה והערכה פועלות המכונות באופן אווטומאטי), ולא רק הערכה מחדש - אלא גם שינויים במהלך המכונות, התאמה לכמה פרטים של המכונות ושל ענינים שמחוץ למכונות, שאין כאן מקום לבארם. והערכה ושנויים הנ"ל גם בהם כמה ענינים במלאכות דאורייתא , כידוע לכל מכונאי. והאומר אשר אפשר להעריך המכונות ולהכינם לפני כניסת השבת באופן אשר משך כל המעת לעת דשבת קדש יפעלו באופן אווטומאטי ולא יצטרכו אף פעם להעריכן ולשנותן וכו', הרי זה - מנקודת מבט של מכונאי - עם הארצות היותר גדולה.
(ואף שבשכל עיוני אפשר לסדר אני' שתוכל להמשיך דרכה באופן אווטומאטי לא רק יום אחד אלא זמן בלתי מוגבל, אבל עוד כמה שנים יעברו עד שתתגשם אפשריות זו).

ובהנוגע לנקודה השני' הנ"ל, היינו אם יש מקום לסכנת נפשות, או על כל פנים ספק דפקוח נפש, באם יסדרו נסיעת האני' באופן שתשבות כל השבת בנמל או אפילו לעגן אותה בלב ים, הנה פשיטא שאין מקום אפילו לספק פקוח נפשות בהעמדת האני' בנמל, ופשיטא גם כן שאין כל מקום אפילו לספק פקוח נפשות בהעמדת האני' בלב ים, ולא רק ברוח מצוי' אלא אפילו ברוחות בלתי מצויות, כיון שאין הצלת האני' מסכנת רוח בלתי מצוי' על ידי פעולת המכונות, אלא על ידי בנין המתאים שלה ולפעמים רחוקות ביותר על ידי בריחה מן הרוח סערה. ועוד זאת ועיקר למודעי - שלא כימים הראשונים ימים אלו, כי ידיעות ע"ד רוח סערה המתקרבת מתקבלות כמה וכמה שעות לפני בוא הרוח למקום פלוני. ויש די זמן להפעלת המכונות מחדש, אם נכבו מקודם מפני קדושת השבת וכיו"ב.
עוד יש אומרים, וגם אמירה זו לא פחות מוזרה מהשמועה הנ"ל, אשר עמידת האני' בלב ים עלולה להגדיל החשש דהתנגשות שתי אניות - יותר מאם האני' במהלכה.
ופשוט שזהו היפך שכל הבריא והפשוט, כיון שאני' המתקדמת ובמהירות גדולה - לפי ערך - דאניות דזמננו, קשה יותר לשנות מהלכה או להעמידה באם לפתע פתאום נודע שאני' שני' מתקרבת אלי', מה שאין כן אם נמצאת האני' במצב של מנוחה. ובפרט שחשש זה בכלל רחוק הוא על פי הסדר המסודר בזמננו שאניות ההולכות בים שולחות ידיעות מברקיות לכל אניות שבדרך בשביל למנוע התנגשותן זו בזו. ושליחת ידיעות אלו ביחד עם פנסי אור שנמצאים על האניות - הם אופני מניעת התנגשות ולא הליכת האני' אשר אדרבה מקשה בזה.
באמת אין כל הנ"ל צריך אריכות, ולא באתי בשורותי האמורות, אלא מפני ששמעתי לתמהוני, שיש שני סוגים "מתירים" הפעלת המכונות ונסיעת האניות בשבת מפני ב' טעמים הפכיים: סוג אחד אומר שאין כל צורך לתפיסת יד אדם כיון שבמשך כל המעת לעת האני' מתנהגת בפועל באופן אווטומאטי; וסוג שני אומר היפך הגמור, שיש סכנה או עכ"פ ספק סכנה באם לא תופעלנה המכונות ע"י בנ"א, וצריכות הן השגחה מיוחדת, וסכנה גדולה... בהעמדת האני' בלב ים.
(אף שגם לדעתם אינו מובן כלל מפני מה אי אפשר להעמידה באיזה נמל, כי כמה וכמה איים ונמלים נמצאים בדרך מהכא להתם ומהתם להכא. ומדגיש הנני זה כי ימים אלו התחילו לפרסם כאן נימוק חדש להיתר והוא: א"א לאניות הנ"ל להגיע מכאן לאירופה במשך ששת ימים. - ומשמיטים הידיעה אשר בדרך ישנם כמה נמלים, נוסף על האפשריות דהעמדה בלב ים).
על פי כל האמור לעיל מובן ג"כ שאפילו אם לא הי' שום שואל - אין שייך כאן הענין דמוטב שיהיו שוגגין, כיון שהוא מדאורייתא ומפורש בתורה (הבערה) וכו'. ועוד ועיקר גדול שבהתחשב שחלק גדול של הנוסעים הם מאלו שישמעו להוראת מורי הוראה בישראל וימנעו לנסוע באניות הנוסעות גם בשבת קודש, קרוב לודאי שעל כל פנים חלק מהאניות הישראליות יסדרו זמני נסיעתן באופן שביום השבת קדש ינוחו, והרי כדאי הדבר אפילו בשביל אני' אחת. ואין צריך לומר שכל הנ"ל צודק בפרט בהנוגע לנסיעות המאורגנות ע"י מפלגות הדוגלות בשם הדת. שאם תהי' הוראה האמורה ישמעו לה.

בתור הוספה, אף שכנ"ל אינו שייך לענינינו באופן ישר, הרי גם בהשאלה באם יש אני' המפליגה בלאו הכי אם מותר לנסוע בה, הנה בכל השקו"ט שראיתי בכתובים וגם בדפוס בהנוגע להאניות הישראליות, כנראה לא שמו לב לנקודות שהן עקריות בנדון זה, והן:
ישנה האפשריות לנסוע באני' שאינה ישראלית. ואפילו אם תרצה לומר (היפך האמת) שהענין דקנה מיד עמיתך יש בכחו להתיר ההפלגה שבנדו"ד, ישנה אפשריות מלאה לנסוע אפי' באניות ישראליות באופן שלא יוצרכו להיות על האני' ביום השבת באם ירד הנוסע מעל האני' טרם בוא יום השבת ויחכה לאני' ישראלית אחרת, אף שזה יאריך זמן הנסיעה. ואפשריות זו מבטלת ג"כ הנפק"מ בין ג' ימים לפני השבת ולאחרי זה (לדעת הר"ח, הרמב"ן, הרז"ה ועוד*). נוסף על זה יש אפשריות לנסוע באוירון ישראלי - היוצא לדרכו והבא - בימות החול.
מלבד עצם השאלה, נתוסף באניות שבדורות האחרונים עוד ענין, שכל השירותים דהנוסעים באני' קשורים בעשיית מלאכה ובחלקם - מלאכות דאורייתא , וכמו המתקת המים וכן הספקת המים לתאי הנוסעים נעשית ע"י מכונות, והוא הדין להארת חדרי הנוסעים, ומהם גם מקום התפלה וכו' וכו'. ואין בזה הענין דנר לאחד נר למאה, כיון שעכ"פ רובם המכריע של הנוסעים הם יהודים, ועוד זאת - כשמתרבה מספר הנוסעים מוסיפים במספר המכונות או בשעות עבודתן (ראה ג"כ כלכלת שבת לבעהמ"ס תפא"י מלאכת שבת ס"ט). ז.א. שבמקום סכנת נפשות אמיתית דהנוסע, שיתירו לו הנסיעה, על הרב להודיעו שאסור, איזה זמן לאחרי כניסת השבת, ליהנות מהמים שבאני', מהאור וכו' (כי ברוב הפעמים אין חולה באני' - כנראה ביומני האניות, נוסף על העיקר שאין בזה כלל הענין דנר לאחד - נר למאה), אסור לקדש על היין וכו' וכו'.
כן להעיר אשר באניות גדולות כהנ"ל - הוא בגדר דפסיק רישי' שבמשך מעל"ע לא יהי' קלקול בשום אחת מהמכונות ויודרש תיקון על אתר.

בכדי לצאת ידי כל הטוענים, מביא אני עוד טעם הנשמע באויר, והוא שהעמדת האני' או הפסקת הנסיעה מעת לעת קשורה בהיזק כספי גדול, ולכן יחסרו האמצעים הדרושים לקנית נשק וכו' וכו'. אבל מובן שמטעם זה אין כל מקום למלחמה על שמירת השבת בבתי החרושת ובשדות וכו' אשר באה"ק ת"ו, שהרי ע"י שביתתם בשבת ההיזק הכספי עוד יותר גדול מהיזק הכספי אשר ע"י שביתה בנסיעת האניות.
ועוד להוסיף, שבכל האמור לעיל לא נגעתי כלל בהשאלה דחילול קדושת השבת בשם חלק חשוב של בני ישראל, שהרי בהנוגע להאניות האמורות הנה עמא דבר - והרבה יותר מעשרה בישראל - מביטים עליהן כנכסים של כל עמנו בנ"י והאניות דוגלות בשמו. על אכו"כ בהנוגע להערכת אומות העולם עליהן.
קשה להאריך בדבר המכאיב ומבהיל וביחוד שעל פי דברי הרמב"ן הידועים שעליהם תמך יתדותיו החתם סופר (שו"ת ח"ו סי' צ"ז) יש באופן הנהגת האניות הישראליות, אפילו אם לא הי' מקום לכל האמור בענין דאיסורי דאורייתא, ענין של פרהסיא והעדר שביתה הכי גדול - שעל פי דבריו חל על זה ענין דאורייתא.
ולהעיר ג"כ מרמב"ם הל' שבת רפכ"א וס"פ כ"ד. מכילתא דרשב"י ויקהל לה. רש"י (בש"ס ועל הרי"ף) ביצה לז, א. ועוד.
