I received your letters in due time[1]. You are no doubt accustomed to receiving my replies with delay, but what can be done — my obligations do not diminish, quite the contrary.

I thank you for having participated in the meeting with Rav Herzog[2] and for informing me of it. I have good hope that this will have positive consequences for the situation of the Chassidim* refugees in the Holy Land.

You ask me about the commentary of the Ramban*, at the end of Parshat* Acharei Mot*, defining three characteristics of the excision of the soul, the Karet*. He says, in particular, that only the soul is cut off. The person, on the other hand, may live for a long time. It is in this regard that it is said: 'the soul shall be cut off', for those who commit many transgressions.

You say that this statement contradicts the question raised by the Admur HaZaken* in the fourth chapter of Iggeret HaTeshuvah* and you thus interpret the expression of the Admur HaZaken* 'for a great number of them', from which you deduce that some of them did not commit many transgressions[3].

In my humble opinion, this explanation is not acceptable. Indeed:

A) The Admur HaZaken* says that those who have committed many transgressions cannot live long, the connection with the source of their soul having been severed. They are thus unable to receive vitality from any other source.

And it is difficult to think that one who has committed multiple transgressions receives, on a personal level, the same status as all Jews living after the destruction of the Temple[4].

B) At the end of the fifth chapter, the Admur HaZaken* cites, with regard to the Karet* of years, the verse 'the soul shall be cut off'. It is therefore clear that he does not adopt the position of the Ramban*.

The Bachya* develops the same explanation as the Rambam*, but the Admur HaZaken*, basing himself on the writings of the Ari Zal*, applies the words of the verse 'the soul shall be cut off' to the Karet* of the body, without making any distinction.

The Meiri*, commenting on the beginning of the fifth chapter of tractate Kiddushin*, speaks of the needs one must provide for Shabbat*[5]. You note that this corresponds to the statement of the Admur HaZaken* in the Shulchan Aruch* Orach Chaim*, chapter 250[6]. This is a fine explanation, but one must carefully analyze the words of the Meiri* to verify its accuracy.

You also ask me the meaning of Rashi*'s commentary on tractate Kiddushin* 40a[7]. In my humble opinion, it is the following. At the simple level, it is difficult to understand the statement of Rabbi Tzadok* that one who acts in such a manner may consume such food. The Torah clearly forbids consuming impure food and itself punishes with lashes one who does so, whereas a relationship with an Aramean woman is only forbidden by our Sages and punished by flogging according to their ruling.

According to Rashi*, Rabbi Tzadok* was speaking to himself and was not addressing the Aramean woman. He therefore wonders what the phrase 'one who commits such an act may consume such food' means. He deduces that, for Rabbi Tzadok*, one who has relations with an Aramean woman deserves to consume impure food.

There is an important teaching here, for this was in a case of force majeure. Now, Hashem confronts the Righteous with a difficult situation only in the domain of food. Nevertheless, they may also encounter the first situation. And Rabbi Tzadok*, seeing that it resulted in the necessity of consuming impure food, deduced that this was indeed, in this case, a matter of food, and he was thus able to establish what his own level was.

Avot DeRabbi Natan* reports a similar account regarding Rabbi Tzadok*, one of the Sages of the Mishnah*, who was a Kohen*. In tractate Kiddushin*, on the other hand, it is presumably a Sage of the Gemara*, since he is cited among them.

You ask me about what I wrote concerning the superiority of those who attain Teshuvah*[8]. You point out to me that the Babylonian Talmud rules clearly in this direction, that there is therefore no dispute, since the Halachah* cannot accept the opinion of the student[9]. Nevertheless, I have not found mention of this principle in the Talmud. Even if that were the case, I do not know whether it could apply here, since one finds elsewhere a contrary statement.

The Sdei Chemed* specifies in which case this principle applies.

ומקשה, דלכאורה, סרה קושית אדה"ז באגה"ת פ"ד. ומתרץ דלכן אמר אדה"ז "כמה וכמה" שכוונתו שבודאי יש ביניהם גם כאלו שאין עונותיהם מרובין.

- ולפענ"ד אא"פ לתרץ כן:

א) ע"פ ביאור אדה"ז שם - גם כשעונותיהן מרובין אי אפשר שיחיו, כיון שנפסק החבל ואין לו חיות ממק"א. ודוחק גדול לומר דכשרבו עונותיו נעשה בפרט זה כמו בכלל האומה לאחר החורבן.

ב) בספ"ה שם מביא אדה"ז לענין כרת דשנים הכתוב דונכרתה הנפש גו' - מוכח בפירוש דלא ס"ל בשיטת הרמב"ן.

והנה גם בחיי שם כתב כשיטת הרמב"ן. ודעת אדה"ז הוא ע"פ הנמצא בכתהאריז"ל (בלקו"ת להאריז"ל פ' בא. בס' הלקוטים פ' לך. ועייג"כ בס' הגלגולים פ"ו ובעמה"מ ש' עולם התוהו פ' סג) שמביאין ונכרתה הנפש אכרת דגוף. ואין מחלקים כלל.

מש"כ בדברי המאירי (קדושין רפ"ה ד"ה והמשנה הא') בצרכי הנאת שבת דאולי כיון לדברי אדה"ז בשו"ע חאו"ח סר"נ קו"א סק"ב - רמז יפה הוא, אבל צ"ע בפי' המאירי אם מדייק הוא כ"כ בתיבות.

ומה דשאילנא מהי כוונת פירש"י קדושין (מ, א ד"ה אמר) - לפענ"ד הוא, דלפי פשוטו אינו מובן כלל הא דאמר ר"צ דעביד הא אכיל הא (ועיין רי"ף על הע"י). ובפרט דמאכל טמא הוא לאו מפורש מה"ת ובמלקות, וזנות דארמית אינו אלא במכות מרדות דרבנן.

ולגירסת רש"י דאמר זה ר"צ לעצמו ולא להארמית, מהו התוכן ב"דעביד הא אכיל הא".

ולכן פירש"י דלמה מזה ר"צ דהבועל ארמית ראוי למאכל טמא. ולמוד גדול הוא. דהנה בנדו"ד הי' כ"ז באונס. וידוע דאין הקב"ה מביא תקלה לצדיקים, אבל דוקא במידי דאכילה (תוס' גיטין ז, רע"א ובכ"מ). וכשנזדמן האונס הא', ה"ז, לכאורה, שייך גם בצדיקים. אבל כשראה ר"צ שזה קשור באכילת דבר טמא למד מזה שגם בעילת ארמית הוא בסוג הנ"ל. ובמילא יכול ללמוד ג"כ מדריגתו מה היא. וכיו"ב. ולהעיר מאדר"נ (פט"ז ב) במאורע עד"ז בר"צ הכהן תנא . אבל בקדושין לכאורה מדבר באמורא מדהובא בין שני אמוראים.

ומה שהקשה על מש"כ אני בפסק דבע"ת גדולים כו' דה"ה ברור בבבלי, ולא מחלוקת, מפני דאין הלכה כתלמיד כו' - אבל כלל זה לא מצאתיו בש"ס גופא (גם אם הי' נמצא בש"ס סתם, ולא ביחס לפלוגתא זו, מסופקני אם זהו בירור גמור, כשברור במק"א להיפך).

- אם הכלל הוא גם כשלא נחלקו פא"פ ראה שדי חמד א' כלל קסא שכ"ה דעת הרי"ף וכו'.

פרש"י קדושין (מ, א ד"ה אמר): מאי נפקא מינה, דהא מילתא דלא נזדמן לי אלא מאכל טמא יש לי ללמוד מכאן דעביד האי, הבועל ארמית, ראוי למאכל טמא. על מש"כ אני: סה"מ תש"ט ע' 3. וראה גם לעיל אגרת תקד.
