To the eminent Rav, distinguished Chassid* who fears Hashem,

devotes himself to communal needs, of

vast knowledge, Rav Sh. Y. (note: Rav Shlomo Yosef Zevin, of Jerusalem; see also letter no. 5360),

Greetings and blessings,

I have duly received your letters — from the conclusion of Shabbos* Parshas Balak* and the previous one. May Hashem grant that you bring me good news of everything you write.

Indeed, these days are propitious for such good news (note: this paragraph appears in letters written to many individuals), since they are the days of liberation — the 12th and 13th of Tammuz* — the liberation of our master, through an evident miracle totally transcending the ways of nature. Now, "the body follows the head" and each year everything is obtained anew — the revelation, the blessing — as was the case the first time, according to the well-known allusion (note: see also letter no. 5336) found in the verse: "These days are commemorated and relived." Indeed, when they are commemorated in the manner that is fitting, they are relived, with their revelations and their blessings.

You mention, in your third letter, the difficult situation of a certain person. In fact, I myself am intervening in this matter, given the exceptional nature of this situation. It is certainly difficult, but it is impossible to remain idle.

I have just received your book Or HaHalacha*. As a token of appreciation and friendship, I note below two or three brief remarks. For the time being, I have not yet received the second volume of the Sipurei Chassidim*.

I thank you for having mentioned the writings of B. Marc. In the meantime, you have surely learned that he himself has entered into contact on this subject with Rav P. Althuiz.

Notes on Or HaHalacha:

War, page 11: You advance that the breastplate of the High Priest is consulted for a discretionary war (note: as opposed to an obligatory one). However, the Rambam* compares it to the sacrifices, and from this perspective, he makes no distinction between the First and the Second Temple. It follows that according to him, it is not obligatory to consult the breastplate. It suffices to obtain "the opinion of the High Priest." Granted, it is stated "He shall inquire of him," but that is merely a narrative (note: not an injunction) regarding how the High Priest would form his opinion. And the Rambam's* position is based on the actual practice of discretionary wars during the era of the Second Temple.

On this point, this passage of the Rambam* is not found at the end of his fourteenth section, but rather at the beginning of the Sefer HaMitzvos*. The Rambam* writes there: "I shall now begin..." But the editors lacked precision in the division of paragraphs and page headings.

Page 117, in the note: You surely know that Rav Kahana, may he live long, has already responded to this (note: regarding imperfect observance of Shemitta* provisions in the lands of Eretz Yisrael*) and his words have been published. I am somewhat surprised that no mention is made of this. Many authorities exclude any sale entirely, yet you cite them only in passing.

From page 302: During one of the Chassidic* farbrengens* (note: see Likkutei Sichos* vol. 1, p. 146; vol. 6, p. 72; vol. 7, p. 114; see also letter no. 5743), a similar point was explained at length — the controversy between Beis Shammai* and Beis Hillel* regarding the New Year of the Trees. But an essential point must be added. Beis Hillel* and Beis Shammai* do not disagree regarding all the laws of the Torah*, even though they always have an aspect of potential and another of actual (note: Beis Shammai* adopts the former, Beis Hillel* the latter). Indeed, one cannot imagine that the potential aspect suffices only insofar as the future is concerned. This is the case, for example, for Rosh Hashanah* (note: a day that carries within it what will follow) or for the capacity to become impure, or for miracles — notably the lights of Chanukah* (note: each day, a certain number of festival days remain to be celebrated). In all these cases, the present situation is altered in light of the future. Tractate Shabbos* 97a establishes this, stating that the positive element can be the most powerful and that there can be a miracle within a miracle. It is precisely for this reason that this text speaks of a "miracle within a miracle."

כה"ג". ומש"נ ושאל לו - סיפור דברים הוא איך יחליט הכהן את עצתו. והכריחתו לרמב"ם לפרש כן - המציאות דבבית שני מצינו ג"כ מלחמת רשות.

דרך אגב: הרמב"ם הנ"ל אינו סוף שורש יד, כ"א התחלת סהמ"צ, וכדברי הרמב"ם: ועתה אתחיל כו'. והמדפיסים לא דייקו בחלוקת הפסקות וכותרת העמודים.

עקי"ז. בהערה. ודאי ידוע שמכבר הגיב ע"ז הרב כהנא שי' ובדפוס. ולפלא קצת שאין מוזכר עד"ז. והעיקר - ע"ד דברי הנ"ל בשם כו"כ להפריך כל ענין המכירה. וכת"ר הביאם בדרך מעבר לחוד.

עש"ב ואילך. באחת ההתועדויות דובר בארוכה מעין זה בטעם פלוגתת ב"ש וב"ה בר"ה לאילנות. ובהוספת נקודה עיקרית, שבכ"ז לא בכל דיני התורה נחלקו ב"ש וב"ה, אף שבכ"ד ישנו כח ופועל - כי אין מקום לסברא שהבכח מספיק, אלא בדינים ע"ד ענינים שבכח (מה שבעתיד) חלק מהם, וכמו ר"ה, הכשר טומאה וכו'. וכן נס (וכמו בנ"ח) - שהוא משנה וכולל בתוכו גם העתיד, וכדמוכח מהוכחת הש"ס (שבת צז, א) דמרובה מדה טובה כו' ושנס בתוך נס הי'. - ועפ"ז מבואר ג"כ מה שבכלל הובא שם המאמר דנס בתוך נס.
