Greetings and blessings,

I learned with pleasure of your effort toward the publication of the work of one of the early Sages, the Halachos Gedolos*, with a comprehensive commentary. Hashem has granted you the merit and success of the forthcoming publication of this work. May Hashem grant that, with largesse, you strengthen yourself in the Torah*, in its "great" (Gedolos) parts — which indicates that there also exist "small" ones, that there is a "great principle" and a "small principle," in the words of our Sages in Tractate Bava Basra 134a — the body of the Torah* and its soul, according to the expression and explanation of the Zohar*, Vol. 3, p. 152a — a complete Torah*.

Regarding the letter of recommendation (note: see letter no. 5659), you know that it is not customary to write such letters in the house of the Rebbe, and you will kindly excuse me. As a mark of appreciation for the words of the early Sages, from whom we receive life, I reproduce here some notes on the printed sheet from the beginning of this book, which you left with me.

Mishneh Halachos, paragraph 1 (note: the Halachos Gedolos states: "A Jew who desires to marry must first say the Kiddush. The betrothal blessing is recited and he gives this woman a marriage document. For Rav Nachman said: Huna told me from where we derive that the marriage blessing is recited in the presence of ten people — from the verse: 'And Boaz gathered ten men from the elders of the city.' Rabbi Abbahu objected: We derive it from the following verse: 'In the congregations, bless Hashem Elokim, from the Source of Israel.'"): It first speaks of the man and of Kiddushin*, because the Mishnah* says: "The man espouses," and likewise, the verse says: "When a man takes a wife." You will also consult the Rambam*, at the beginning of the Laws of Marriage. True, at the beginning of the first chapter of Tractate Kiddushin, it says: "The woman is acquired," but the Gemara* explains why this is so. Moreover, the text speaks of Kiddushin*, of blessing, of transmission of the marriage document — all actions that are incumbent upon the man. You will consult the explanation of our Sages, cited by Rashi*, in his commentary on the verse Shmuel I 20:30. One may wonder whether the formulation of the Halachos Gedolos* is indeed: "A Jew who desires to marry," which seems self-evident (note: why specify that it is a Jew?). Indeed, the version of the Or Zarua is later cited as: "One who wants to marry." Perhaps this formulation echoes the conclusion of this paragraph: "from the Source of Israel."

Continuation of the text — "he gives this woman a marriage document": There are several opinions regarding the moment of giving this document, in the Rambam*, Laws of Marriage, chapter 10; the Tur*, Shulchan Aruch*, Even HaEzer, end of chapter 6, and its commentaries. In any event, it is surprising that it does not state here whether the marriage blessing is recited before or after this transmission. In my opinion, there is an obvious omission by the copyist and the printer. The She'iltos*, Chayei Sarah, chapter 16, states: "One who desires to marry must first say the Kiddush, recite the betrothal blessing in the presence of ten people, say the marriage blessing in the presence of ten people as well, and give this woman the marriage document." The same must therefore apply in our text, which enables one to understand its continuation: "Rav Nachman said... one derives that the marriage blessing..."

The Emek HaShe'eilah*, basing himself on these She'iltos*, corrects the Halachos Gedolos* and adds: "in the presence of ten people" after "betrothal blessing." He explains that his aim is to draw proof that ten people are necessary for the marriage blessings — which is not the subject of his discussion, since it is so for the betrothal blessings. Nevertheless, the Halachos Gedolos* should have specified this, and one may still ask why it does not speak of the marriage blessings.

Mishneh Halachos, paragraph 2: Our master does not say: "the son of Nathan" (note: "Huna, the son of Nathan, told me"). The same is true in the She'iltos*. The Emek HaShe'eilah* deduces that this expression in the Gemara* is a printer's error. Indeed, Rav Huna bar Nathan exercised his authority after Rav Ashi, who was born when Rava — the colleague of Rav Nachman — died. The Seder HaDoros, in the entry on "Rav Huna bar Nathan," notes that he posed questions to Rava, as reported in Tractate Nedarim 12a. But perhaps he was very old, or perhaps there were two Sages bearing this name. In the commentary of Rashi* on Tractate Nedarim, however, one finds only "Rav Huna" and not "bar Nathan." It is worth investigating what the Sages say on this subject.

Mishneh Halachos, paragraph 3: The marriage is celebrated with the nuptial canopy and the ring of sanctification. Our Sages say that one must strive to confer value, and for this purpose, I reproduce here what the Alter Rebbe*, author of the Tanya*, writes in his Torah Or*, p. 98d: "We say that 'Hashem sanctifies His people Israel with the nuptial canopy and the ring of sanctification.' Our Sages ask why the order was inverted in this blessing, so that the canopy is mentioned before the ring. In fact, the nuptial canopy surrounds, and this recalls that 'He placed the mountain above them' (note: Mount Sinai, at the giving of the Torah). Thus, there is a revelation of the Surrounding Light. This is why the canopy had to be mentioned before the ring. Indeed, in order to come receive the Torah* and this ring, it was first necessary to bring to light the Surrounding Light, which inspires submission, by virtue of which all declared: 'We will do and we will hear.' It is in this way that the Torah* could be revealed."

ויה"ר אשר מתוך הרחבה ירבה חיילים בתורה, ובתורה בכלל גדולות (מכלל דאיכא) וקטנות, דבר גדול ודבר קטן כפירוש רז"ל (ב"ב קחד, א), גופי תורה ונשמתא דאורייתא, כלשון וביאור הזהר (ח"ג קנב, א), תורה תמימה.

משנה הלכות. סק"א. בר ישראל - מתחיל באיש: בר ישראל כו' לקדושה כו', וכל' המשנה האיש מקדש - שהרי כן הוא לשון הכתוב: כי יקח איש אשה גו'. ראה ג"כ ל' הרמב"ם ריש הל' אישות.

ובפרט בכאן, שממשיך: מיבעי' לי' לקדושה כו' וברוכי כו' ומימסר כו' - אשר כ"ז פעולות האיש הן.

ולהעיר מדרז"ל הובאה בפירש"י (ש"א כ, ל).

יש לברר אם זהו סגנונו דבה"ג " בר ישראל דבעי" דלכאורה פשיטא הוא.

ולקמן מובא מאו"ז הגירסא " מאן דבעי". ואולי נקטי אגב דסיום הענין: ממקור ישראל.

בפנים. ומימסר לה כתובה. זמן מסירת הכתובה - כמה דיעות בזה: רמב"ם הל' אישות פ"י. טוש"ע אה"ע סס"ו וש"נ בנ"כ.

והנה, בכל אופן, תמוה שלא הוזכר כאן ע"ד ברכת חתנים אם לאחרי המסירה או לפני'.

ולדידי השמטת המעתיק והדפוס דמוכחה היא.

ובשאילתות (חיי שרה, טז): מאן דבעי למינסב איתתא מיתבעי לי' לקדושי ברישא וברוכי ברכת אירוסין בעשרה וברכת חתנים בעשרה ומימסר לה כתובתא. ועל דרך זה צ"ל כאן.

ואתי שפיר גם המשך הענין: דאר"נ כו' מנין לברכת חתנים.

ובהעמק שאלה על השאילתות שם מגי' ומוסיף בבה"ג כאן תיבת בעשרה, אחרי התיבות ברכת אירוסין, ומפרש כוונתו להביא ראי' מב"ח (דלא איירי בה כלל ) דצריך עשרה על ב"א דצריך עשרה, - ומלבד דהו"ל לבה"ג לפרש זה - הרי נשארה הפליאה דהשמטת ענין ב"ח.

משנ"ה סק"ב. ורבינו לא גרס בר נתן. וכן לא גרס זה בשאילתות שם. ופי' בהעמק שאלה דעכצ"ל דתיבות ב"נ בש"ס טה"ד הוא, כי רהב"נ מלך אחרי ר' אשי שנולד כשמת רבא חבירו של ר' נחמן. - וכבר העיר בסה"ד (מע' רב הונא ב"נ) מצינו דרהב"נ הקשה לרבא (נדרים יב, א) ואולי זקן גדול הי' כו', ואולי שנים היו.

אבל ברש"י נדרים שם נדפס ר' הונא סתם בהשמטת התיבות בר נתן. ויל"ע בכ"ז בדקדוקי סופרים.

משנ"ה סק"ג. ע"י חופה וקידושין. ע"פ מרז"ל מילתא אלבישייהו יקירא, מעתיק הנני מש"כ בזה במאמר אדמו"ר הזקן (בעל התניא), בספרו תורה אור (צח, ד) וז"ל: מה שאומרים מקדש עמו ישראל על ידי חופה וקדושין, והקשו למה שינו הסדר להקדים חופה לקדושין, אלא כי החופה הוא בחינת מקיף והוא ענין שכפה עליהם הר כגיגית שזה בחינת התגלות המקיף כנ"ל, ולכן הוצרך להקדים החופה לקדושין שכדי שיבאו לקבלת התורה שהוא בחינת הקדושין הוא ע"י המשכת המקיף תחלה שעל ידי זה באו לבחינת הבטול להקדים נעשה כו', ואז יוכל להיות ההמשכה והגילוי בחינת התורה, עכ"ל.
