To the great Rav*, the distinguished Chassid* who fears Hashem and devotes himself to communal needs, Rav Yosef Eliyahu (note: Rav Y. Rakovski, of Miami),
Greetings and blessings,
I am responding to your letter of the 8th of Tishrei*, in which you ask me about the possibility of associating yourself with Rabbanim* belonging to different categories. In general, it is not my practice to rule on halachic* questions. Certainly, I have made known my position (note: see, on this subject, Igros Kodesh, letter no. 4306) regarding participation in the New York Board of Rabbis and Synagogue Council. I had to do so, given the turn the situation could take, Heaven forbid. Nevertheless, your question is an extension of this one, and I therefore write to you what is my definitive opinion in this matter:
A) Is it judicious to associate oneself, within the framework of a rabbinical court, with Rabbanim* who, in their synagogue — described as Orthodox — do not place the Torah* reading table in the center of the prayer hall, or who permit women to take their place among the men, even though a women's section exists? Moreover, should one associate with a Rav* who is considered Orthodox, as is his synagogue, even though in it there is no separation between the men and the women?
I stated, in the letter I wrote regarding participation in such organizations, that in this matter, it is the conception, more than the concrete action, that must be considered. If a Rav* says that, according to his conception, the entire Torah* was given on Mount Sinai except for a single verse, he is a heretic, in accordance with the ruling of the Torah*, even if he otherwise fulfills all the mitzvos* down to the smallest detail. It is then, of course, forbidden to associate with him in order to rule on the Halachah* within the framework of a rabbinical court, to use the expression in your letter.
Conversely, if a Rav* acknowledges that Jewish practice comprises six hundred and thirteen mitzvos* with all their details, that the entirety of the Torah* emanates from Heaven, but he otherwise commits transgressions because he is a victim of his evil inclination, which subjects him to temptations and desires — for he must earn his living — he is a Rav* who transgresses the Law, which does not prohibit associating with him in order to rule on it. You can deduce from this what is appropriate to do in this matter.
B) The synagogue, with everything that pertains to it, is a public place, at the disposal of the greatest number. Consequently, it is clear that its members must react if the reading table is not placed in the center, or if some women take their place where the men are, or if there is no separation at all between the men and the women. Now, they have been told that according to the Shulchan Aruch*, these practices are forbidden, but they respond that in the United States, everything is different. This point was discussed by the leaders of the synagogue, and the Rav* complied with their opinion.
In such a case, it is not a matter of the fault of one person, nor even a fault at all, but rather a fundamental modification of the Shulchan Aruch* and of our holy Torah*. From that point on, it matters not whether the Rav* defines himself as Orthodox or not. And I am happy to be able to add that several young Rabbanim* of my acquaintance, whose synagogue finds itself in the situation just described, proclaim therein, on the contrary, that a separation between the men and the women is indispensable according to the Shulchan Aruch*. And from time to time, they place this point on the agenda of the synagogue's leadership once again.
C) Is it permissible to associate, under the conditions just described, with a Rav* whose synagogue possesses a microphone and who uses it himself during Shabbos* (note: see, on this subject, Igros Kodesh, letter no. 5378) and the festivals, or which does not have a separation between the men and the women?
All those who know even a little about technology know that the use of a microphone during Shabbos* and the festivals is a definitive prohibition — by a rabbinic enactment and perhaps even by a principle of the Torah*. And this takes place in a synagogue and therefore receives wide dissemination. Moreover, to use the expression of the verse, it is "seducing the queen while I myself am in the house." The Shulchan Aruch* indicates how one should regard someone who desecrates Shabbos* publicly, particularly when he presents himself as a Rav*, that is, as the spiritual guide of a community.
It is, of course, absolutely out of the question to associate with such a person within the framework of a rabbinical court to rule on the Halachah*. Naturally, even the best separation between men and women changes nothing about this. Similarly, the fact that the Rav* protests against the use of the microphone and claims that he is forced to do so changes nothing about this situation. He is no less one who desecrates Shabbos*, and whatever pressures are exerted upon him, it is certainly impossible to imagine that this constitutes a case of duress authorizing this dreadful desecration of Shabbos*.
May Hashem enable all those who overcome this trial to become conscious of the truth, to set aside the erroneous conception according to which, by accepting the compromise (note: see, on this subject, Igros Kodesh, letter no. 5378), they will draw the members of the synagogue closer, ensure their livelihood, and receive honors. Above all, it will be recognized that they are not good-for-nothings from another era. Indeed, in recent years in the United States, one can witness the reverse of this situation. The members of communities are beginning to recognize the truth. They understand that he who accepts a compromise on a third of the whole has no reason to stop there — that he will go to half, then to nearly all of it. He may be a good speaker, an effective communal leader, appreciated by the other members and by their families. Deep down, they hold him in contempt, for they know he is dependent on the salary they grant him. And, in the expression of our Sages*, "today, he asks him this" (note: and eventually, the evil inclination leads him to serve idols).

במענה על מכתבו מח' בתשרי, בו שואל דעתי בהנוגע להתחברות עם רבנים מסוגים שונים.
והנה בכלל אין מעניני לפסוק שאלות, ומה שפרסמתי דעתי בענין ההשתתפות בנויארק בארד אוו ראבאייס וסינאגאג קאונסיל, הכריחני לזה מצב הדבר בראותי שעלול הדבר ח"ו וכו'.
אבל כיון ששאלת כת"ר הוא בהמשך להנ"ל, הנה גם בזה כותב הנני את הנראה לדעתי ברורה, והוא:
א) האם נכון להתחבר בעניני הלכה בתור בית דין עם רבנים כאלה אשר בבית הכנסת שלהם, הנקרא אורטודוכסי, אין בימה באמצע, ואף שיש מחיצה הנה כמה נשים יושבות גם בתוך בית הכנסת, וכן עם אלו אשר אין בביהכ"נ שלהם כל מחיצה, אבל הרוב וכן הבית הכנסת נקראים בשם אורטודוכסים.
כבר כתבתי במכתבי בהנוגע לההשתתפות בארגונים הנ"ל, שבנדון דידן נוגע יותר מהמעשה בפועל - השיטה, ז.א. אשר רב האומר ששיטתו, שכל התורה נאמרה למשה מסיני, חוץ מפסוק אחד כו', הנה אף שמקיים במעשה בפועל כל המצות ודקדוקיהן כבר נפסק דינו בתורה אשר כופר הוא, ומובן שאסורה "ההתחברות עמו בעניני הלכה תור בי"ד" כלשונו במכתבו, לאידך גיסא רב האומר שיהדות היא כל תרי"ג המצות ודקדוקיהן וכל התורה מן השמים היא, אף שנכשל באיזה ענינים מפני שיצרו אנסו בפיתוים והסתות (שזה נוגע לפרנסתו וכו') - ה"ז רב עובר עבירה, ואין כל עבירת עבירה סתם אוסרת ההתחברות בעניני הלכה וכו'. ומזה מובנת ההוראה בהנוגע להאמור.
ב) כיון שביהכ"נ ועניניו הוא ענין צבורי וברבים, מובן שחשובה ביותר תגובת חברי ביהכ"נ על זה שאין בימה באמצע, וכן - שחלק מהנשים יושבות מבחוץ למחיצה או שאין כלל מחיצה וכו' באם הם מחשבים הדברים האמורים כהיתר גמור, ז.א. שאף שביארו להם שע"פ שו"ע אסור הדבר, אומרים אשר ארצוה"ב שאני וכו' והעלו הענין בדיון בהנהלת ביהכ"נ והרב הסכים לשיטתם, הרי נעשה זה לא עבירת יחיד ולא עבירה סתם, אלא שינוי יסודי בשו"ע ותוה"ק, ואז אין נוגע אם רוצה לקרות עצמו אורטודוכסי או לא, ושמח אני להוסיף אשר כמה מהרבנים הצעירים שהנני מכירם ואשר בביהכ"נ שלהם המצב כהאמור, הרי אדרבה מכריזים בפרסום שמחיצה מוכרחת ע"פ שו"ע ומזמן לזמן מעלים עוה"פ את הענין על סדר היום של הנהלת ביהכ"נ.
ג) האם מותר להתחבר כו' - כנ"ל - עם רב אשר בביהכ"נ יש מיקרופון והרב משתמש בו בשבת ויו"ט, וביהכ"נ בלי מחיצה וכו'.
והנה השימוש במיקרופון בשבת ויו"ט, להיודעים פרק בטכניקה, איסור ברור [מדרבנן, ואפשר גם מן התורה], וכיון שנעשה זה בביהכ"נ, ז.א. בפרסום גדול ועוד בהדגשה ע"ד מ"ש לכבוש את המלכה עמי בבית, המחלל שבת בפרהסיא כבר נפסק דינו בשו"ע, ובפרט כשקורא לעצמו בשם רב. ז.א. מנהיג רוחני של עדתו, ומובן ש"התחברות עמו בעניני הלכה בתור בית דין" מופרכת לגמרי ומחיצה הכי טובה אינה משנה כלום כמובן. כן מובן שבזה אין שינוי אפילו אם הרב מביע מחאתו נגד השימוש במיקרופון ואומר שמכריחין אותו, כיון שהוא הוא המחלל שבת בפרהסיא, ואיך שלא יהי' האופן שמכריחים אותו הרי פשיטא שאין בזה ענין דאונס המתיר חילול שבת מבהיל כזה.
ויה"ר אשר כל העומדים בנסיון בהנ"ל יכירו את האמת אשר לא כהסברא המוטעית שע"י שיעשו "פשרה" יתקרבו אליהם חברי ביהכ"נ ותהי' פרנסתם וכבודם בטוחים יותר, ולכל לראש - לא יקראום שבטלנים הם ומעולם ישן וכו', כי הנה דוקא בשנים האחרונות בארצוה"ב רואים את ההיפך, שגם הבע"ב מתחילים להכיר האמת שהעושה פשרות לרביע אין מעצור בנפשו להגדיל הפשרה לשליש ולמחצה ולרובו ככולו, ואף שנואם טוב הוא ועסקן צבורי כדבעי ונושא חן בעיני חברי ביהכ"נ הבע"ב וב"ב, הנה בלבבם רוחשים לו בוז, בידעם אשר הכל תלוי בהמשכורת שנותנים לו, והיום אומר לו כך וכו' - וכמרז"ל הידוע.
בברכה אשר חפץ ה' בידו יצליח להחזקת היהדות האמיתית בכל מקום שידו מגעת יהדות תמימה ושלימה וגם נצחית, וכתורה הנתונה לכל בני ישראל לכל הזמנים ולכל המקומות, ולבשו"ט בכל האמור.
