To the great Rav, distinguished Chassid* who fears Hashem and devotes himself to communal needs, of multiple areas of knowledge, the Rav Sh. Y. (note 1: Rav Shlomo Yosef Zevin, of Yerushalayim*. See, regarding him, letter no. 7066),

I greet you and bless you,

I am responding to your express letter of 12 Sivan*, the end of the period of conclusion of the festival of Shavuos* (note 2: During which the festival offerings could be brought until this date). My response is therefore also addressed to you by express. Upon reviewing your correspondence, I realized that I had not yet responded to what you wrote me concerning the application of the rule according to which "the tenth shall be sacred" (note 3: See, on this subject, letter no. 7356), when the animals leave the pen. In my letter (note 4: This is letter no. 7199), the reference to the Likkutei HaShas* of the Arizal*, on Tractate Bechoros*, was omitted. It says, regarding our subject: "The tenth is consecrated upon leaving through the gate. Understand this." You point out to me that, according to the revealed part of the Torah*, the animal can also be consecrated while it is still inside the pen.

One must first clarify that certain points are defined, in the manner in which they must truly be, by the inner teaching of the Torah*. One can cite as an example the most general point — the fact that every Mitzvah* is accomplished through thought — what one must have in mind — through speech — the blessing — and through action — its effective application. Now, for various Mitzvos*, it is not necessary to have any particular thought in mind. Furthermore, the omission of the blessing does not constitute an obstacle to the performance of the Mitzvah*. I specify that this is an example, for a priori, one must indeed have the necessary thoughts and recite the blessing.

It is not the same regarding the exit from the pen. Indeed, one could, from the outset, consider that this exit is not necessary. In fact, this is not the case. On the contrary, according to the Torah*, it is a Mitzvah* that the animals leave the pen and that they be counted by means of a rod on the occasion of this exit. In my humble opinion, even if one has already proceeded in this manner, such is not, in reality, the Halachah* that must be retained according to the revealed part of the Torah*. Here is what I base this assertion on:

A) One can pose the following question regarding Tractate Bechoros* 58b. Our Sages* affirm, as an evident fact, that "the tenth shall be sacred" in any case, even if it was not designated as such. It is not the same for the exit from the pen. Indeed, proofs are sought regarding it, which even seem to balance each other out.

B) The Rambam*, in his Laws of Firstborn Animals, chapter 8, paragraph 8, justifies the possibility of fulfilling one's obligation with the appropriate count of animals, which seems to confirm the necessity of having them leave the pen, according to the question posed by the Lechem Mishneh*.

C) The commentators of the Gemara*, on Tractate Bechoros* 58b and 59b, specify that a valid count includes all the animals capable of leaving the pen, even if concretely they do not leave it.

D) Essential point: how can one consider that the animal that did not leave the pen would be fully consecrated? At what moment would this consecration apply? If one makes the tenth animal leave through another gate, indeed, it would not be consecrated, for it would not be added to the other nine. Furthermore, on what basis can one distinguish death — which is a definitive loss of life — from the exit of a living animal through another gate?

Now, one can answer all these objections if one admits that the tenth animal remaining in the pen is nonetheless consecrated, solely insofar as it will subsequently exit, alive, through the same gate as the others. In such a case, it is retroactively established that it had indeed been consecrated. It is not the same, however, if the tenth animal died in the pen, in which case the Baraisa* does not say it is consecrated. As was recalled, this situation can be compared to that where the animal would exit through another gate. The first nine animals are then exempt from any obligation of tithe because the count was properly established in the fitting manner.

Rashi*, commenting on Tractate Bechoros* 59b, combines the case of the tenth animal that died in the pen with that of its exit through another gate. And he gives the reason: the count was, in such a case, established in the fitting manner. For what concerns our subject, this indeed means that an exit from the pen is necessary, at least by way of clarification. In this regard, the Likkutei HaShas* of the Arizal*, which led me to establish this distinction, emphasizes that it is impossible to say, regarding the Attribute of Malchus*, that everything happens of itself, as is affirmed regarding the Attribute of Binah*, which transcends the chain of worlds. This is what I wrote to you in my previous letter.

You also write to me regarding the manner of lifting the Sefer Torah* (note 5: After its reading, to show it to all. See, on this subject, letter no. 7282) and I am somewhat surprised on this subject that you do not mention the Chabad* custom in the corresponding article of the Talmudic Encyclopedia (note 6: Of which Rav Zevin is the author). Indeed, we set down the Sefer Torah* on the reading table after having lifted it and before having re-dressed it. And one can observe a new fact in this matter. It is precisely the Aruch HaShulchan* who legitimizes such a manner of proceeding and who praises it. I read with pleasure, at the end of your letter, what is said there regarding the bicentennial (note 7: Of the Baal Shem Tov*, celebrated on Shavuos*) and the activities you undertook in this matter. Although you do not specify it, I have good hope that you emphasized, with all necessary energy, the necessity of rejecting the error according to which the Baal Shem Tov* came... (note 8: To lighten the practice of Mitzvos*. See, on this subject, letter no. 7052) for the Mitzvos* that one puts into practice in the best manner. One of the reasons I write to you on this subject is the following: it is good to provide this clarification at all times, and you will therefore do so, at least in the future. Indeed, many are those who commit such an error, even if some do so because they wish to.

I thank you for having sent here the content of the conversation you mention at the end of your letter and especially the content of the discourses delivered during this gathering. Indeed, they had not yet been transmitted to me.

... בעברי על מכתבי כת"ר ראיתי, שעדיין לא עניתי במה שכתב אודות העשירי יהי' קדש בענין יציאה מן הדיר. ונשמט במכתבי הנ"ל הציון ומראה מקום - ללקוטי הש"ס להאריז"ל מסכת בכורות. וז"ל שם בהנוגע לעניננו: מעשר קדש ויוצא דרך הפתח כו' והבן זה. - ולהערת כת"ר מהדין ע"פ נגלה שגם בדיר קדוש, הנה בהקדם - שכמה ענינים מצינו כגון דא, שמבוארים הדברים ע"פ פנימיות התורה כפי שצ"ל הענין מסודר, ומעין דוגמא - ענין הכי כללי, הביאור שכל המצות צ"ל במחשבה (כוונה) דבור (ברכה) ומעשה (קיום המצות בפועל), אף שחלק גדול מהמצות אין צריך כוונה, וברכות לא מעכבות.

כתבתי רק "דוגמא", כיון שעכ"פ לכתחלה כדאית כוונה וברכה. משא"כ יציאה מהדיר, שאפשר הי' לומר שגם לכתחלה אין צריך. אבל באמת אינו, כי אדרבה מה"ת מצוה שיצאו וימנם בשבט. והעיקר - דלפענ"ד, גם בדיעבד הנה לקושטא דמילתא, לא כן הוא ע"פ דין הנגלה, ויסודי:

(א) בסוגיא דבכורות (נח, ב ושם) לכאורה אינו מובן - דרז"ל בפשיטות העשירי קדש מכל מקום, אף שלא קרא שם וכו', משא"כ בהנוגע ליציאה מדיר - שמחפשים ראיות והוכחות. ולכאורה שקולים הם וכו'.

(ב) דברי הרמב"ם (הלכות בכורות פרק ח' הלכה ח') שכותב הטעם דפוטר מנין הראוי, דלכאורה הוא רק אליבא דקס"ד שצריכה להיות יציאה בפועל, וכקושית הלחם משנה.

(ג) לשון מפרשי הש"ס דשם וגם נ"ט עמוד ב', דמשמע דמנין הראוי הוא מעין דכל הראוי לבילה - יציאה - אין בילה מעכבת.

(ד) והוא העיקר, איך אפשר לומר דבהעדר יציאה מדיר קדוש לגמרי דמתי חלה הקדושה, שהרי באם יוציאו העשירי דרך דלת אחרת - אינו קדוש, כי אינו מצורף לתשעה המנוים, ועוד - מאי שנא מיתה ויציאה מגדר חי לגמרי - ממוציא החי דרך דלת אחרת.

וכל הנ"ל מתורץ - באם נאמר אשר הדין הוא דנשתייר עשירי בדיר העשירי מעשר, רק באם אחרי כן יצא חי באותה הדלת, שאז הוברר הענין מלכתחלה דשייך אליהם, משא"כ במת עשירי בדיר, שלא אמרו בברייתא דהעשירי מעשר, וכנ"ל דהוה דוגמא יצא בדלת אחרת - שתשעה המנוים יפטרו רק מטעם דמנין הראוי, ולכן רש"י (בכורות נ"ט ע"ב) צירף מת בעשירי בדיר ויצא בפתח אחר וכתב הטעם דמנין הראוי. ומזה - בהנוגע לעניננו דעכ"פ בתור בירור היציאה מוכרחת ובלקוטי הש"ס להאריז"ל שם, והביאני על החילוק - שאאפ"ל בהנוגע לספירת המלכות דנעשה כל הענין מעצמו, ע"ד שאומרים בספינת הבינה שהיא למעלה מהשתלשלות, וכמ"ש מאז.

במ"ש אודות הגבהה, לפלא קצת שאינו מוזכר בהערך באנציקלופדיא ע"ד אופן הגבה הנהוג בחב"ד, דמניחים הס"ת על השולחן לאחרי הגבה וקודם הגלילה, וראה זה חדש - שדוקא בעל ערוך השולחן, מאשר ומשבח מנהג זה.

נעם לי לקרות בחותם מכתבו אודות ענינים הקשורים בשנת המאתים וכו' ופעולותיו בזה, ותקותי חזקה, אף שאינו מזכיר, שהודגש ובתוקף הדרוש, שלילת הטעות שכאילו הבעש"ט וכו' הקילו בהנוגע לקיום מצות בהידור וכו'. ואחד הטעמים שהנני כותב בזה, שבאם ע"ע לא הודגש כדרוש - מהנכון לעשות זה בכל עת מצוא עכ"פ מכאן ולהבא, כי רבו הטועים, אף שחלק מהם טעות ברצון וכו'.

שיחתו שמזכיר בסוף מכתבו - ת"ח על המשלוח לכאן, ובעיקר - הנאומים בעת הכינוס - כי לע"ע לא באו לידי.
