To the attention of the committee of the Sephardic community of the holy city of Jerusalem, may it be restored and rebuilt, may Hashem grant you long life,

I greet you and bless you,

I received your letter with delay, then your publications, and I thank you for having thought to send them to me. Regarding the content of your letter, you ask me about the question of the Chief Rabbinate, or more precisely of the Chief Rabbi (note 1: The Sephardic Chief Rabbi of Israel), the Rishon LeTzion*, even though it seems that this problem no longer arises, for the moment. However, it is said: "You shall be free of obligation before Hashem and before Israel" (note 2: It is therefore not proper to let doubt persist), and I will therefore specify once more my position (note 3: See, on this subject, letter no. 7474), although it has been the subject of rather wide dissemination. It is the following. In this case, it is in no way a question of a person, but rather of a principle. As a result, the question concerns not only our brethren, the children of Israel, in our Holy Land, may it be restored and rebuilt, but also all Jews, wherever they may be. The honor of the Rabbinate is at stake, which is, of course, that of the Torah*. The question that must be formulated, according to our Torah*, Torah* of life, is therefore the following: is it conceivable to remove a Rav from his sacred functions, especially at the initiative of a commission many of whose members are totally foreign to Jewish practice? The position of the Shulchan Aruch*, in this matter, is very simple and very clear. It totally rejects such a possibility. This also answers the question regarding the election of one Rav or another to succeed him (note 4: Since he must not leave his functions, the problem of his succession does not arise).

You raise the following objection: if such a commission cannot remove a Rav from his functions, how can one say that he must occupy his position for the duration of a certain term and that this commission must then organize elections? Concretely, such a question cannot call into question the Halachah*, especially when it concerns the honor of the Torah*. If one has acted contrary to the Shulchan Aruch* in the past and if one proclaims that one will continue to do so in the future, one does not thereby transform the transgression into a Mitzvah*. I send you my respects, my blessing for a Kosher* and joyous festival of Pesach*, for a true liberation from constraints and barriers, from everything that obstructs the service of Hashem with joy and enthusiasm,

באיחור זמן רב הגיעני מכתבם ואחרי כן פרסומיהם, ות"ח על שימת לבבם לשלחם אלי.

ולתוכן מכתבם בשאלות בעית הרבנות הראשית, יותר נכון - בעית הרב הראשי הראשון לציון, אף שלכאורה כבר אינה אקטואלית כעת, בכל זה על פי מה שנאמר והייתם נקיים מה' ומישראל אבהיר עוד הפעם עמדתי, אף שלכאורה נתפרסמה די צרכה, והיא:

בנידון דידן אין בזה שאלה פרטית כלל וכלל, כי אם ענין עקרוני, ומפני זה נוגע לא רק לכללות אחינו בני ישראל אשר באה"ק ת"ו אלא לכל בני ישראל בכל מקומות מושבותיהם, ונוגע בכבוד הרבנות שכמובן קשור בכבוד התורה. והשאלה היא: המותר על פי תורתנו תורת חיים לדחות רב ממשרתו בקדש, ובפרט על ידי ועידה שחלק חשוב שלה הם אנשים חילוניים בהחלט. וכיון שעמדת השלחן ערוך בזה היא פשוטה וברורה - בשלילת ענין שכזה לגמרי, הנה בדרך ממילא נפתרת גם השאלה בנוגע לבחירת רב פלוני, או פלוני בתור ממלא מקום.

לשאלתם שבאם אין מקום לדחית רב ממשרתו על ידי הועידה הנ"ל אם כן מהו התוכן דהגבלת שירות הרב לתקופה מסויימת ואחרי כן בחירות על ידי ועידה כהנ"ל, הנה קושיא אינה מבטלת ח"ו דין, ובפרט דין הנוגע בכבוד התורה, ועשית דבר שהוא נגד השו"ע בעבר והודעה שיעשו כן גם בעתיד אינה מהפכת עבירה למצוה.

בכבוד ובברכה לחג הפסח כשר ושמח ולחירות אמתית ממצרים וגבולים ומכל ענינים המבלבלים עבודת ה' בשמחה ובטוב לבב.
