Here is what must be understood[1]: It is true that this is not a Torah ruling per se. Nevertheless, the death of the ox can be derived from that of its owners[2], even though one cannot equate a financial loss with a capital offense[3]. The explanation of all this is so self-evident that not only the Gemara*, but also the commentaries of Rashi* and the Tosafot*, did not find it necessary to spell it out. One can state very simply that this explanation is an immediate deduction from the verse itself, which indicates, as if forming an inseparable whole, that: "the ox shall be stoned and its owners shall also die"[4]. Thus, the judgment concerning the ox is not solely a matter of financial loss, as is the case in all other passages of the Torah. In this case, indeed, "its owners shall also die" through the intervention of the Heavenly Tribunal, as stated in tractate Ketubot*[5], which is cited as self-evident by the Tosafot*, commenting on tractate Sanhedrin 15b: "In this passage as well, he shall be condemned to death by the Heavenly Tribunal if he does not pay the ransom."
One can add a clarification on this point. The punishment of the owner can be justified in two ways:
A) He, the owner[6], failed to guard his ox properly, which consequently killed someone. In this case, there is no ransom.
B) Or alternatively, it is the ox, whose financial value[6] belongs to the owner, that is the source of the offense.
According to the first explanation, one can say that the fault of the owner and the offense thereby committed by the ox are two successive events, linked by cause and effect. According to the second interpretation, by contrast, it is at the moment[6] the ox kills that its master then[6] commits a transgression, in the same way that a man's courtyard is considered an extension of his hand[7].
B) The Gaon of Rogatchov states, in his Tzafnat Paaneach* on tractate Sanhedrin 15b: "in accordance with several other passages of the Talmud*". Now, this assertion contradicts what has just been said. One might therefore think that the Yerushalmi* contradicts the Bavli*, which does not envisage a Torah ruling in this matter. Yet the Yerushalmi itself stipulates, in chapter 1, at the end of paragraphs 1 and 2, that the ox is stoned in such a case by virtue of a Torah ruling[6]. Furthermore, the Pnei Moshe*, commenting on the Yerushalmi*, adds that the necessity, in this case, of inflicting upon it the same punishment as its owners[6] — stoning — also derives from a ruling of the verse[6]. However, I have not had the merit of understanding this explanation of the Pnei Moshe*, according to which the essential point — an identical death for all — is not even mentioned by the Yerushalmi*. Moreover, according to his explanation, the death of the ox does not even have an accessory value. For what does it matter for the question he raises here? Likewise, why does he speak of "financial loss" if the matter were solely one of inflicting the same death? In my humble opinion, therefore, this passage of the Yerushalmi* must be understood according to its literal meaning. The stoned ox is purely a matter of financial loss, of which it is said throughout the Torah: "He shall pay money." But, in addition and according to a Torah ruling, it was added that the ox is stoned — and this stoning is a matter that goes beyond monetary reckoning.

שמזה מובן: 1) שאין זה גזה"כ, 2) שאעפ"כ אפשר ללמוד מיתת השור ממיתת הבעלים (אף דלכאו' זהו - לימוד דיני ממונות מדיני נפשות) והסברא בזה פשוטה כל כך - שאפי' רש"י ותוס' (ולא רק הש"ס) לא הוצרכו לפרטה לרוב פשיטותה. וי"ל בפשיטות, דהסברא פשוטה ומובנת בפסוק זה עצמו, "דכלל ביחד השור יסקל וגם בעליו יומת" - היינו כשדנים על השור אין זה רק דיני ממונות כבכל התורה, כי אם גם בעליו יומת (בידי שמים - כדאי' בכתובות והובא בפשטות בתוס' ד"ה אימא סנה' ט"ו: היינו דגם לסוגיית סנהדרין יומת בידי שמים אם לא ישלם כופר).
ויש להוסיף הסברה בזה - דהנה טעם עונש הבעל י"ל בב' אופנים: א) על שלא שמר ( הבעל ) שורו והמית (ולכן אין כופר בתם), או ב) על שממונו (שורו) המית.
באופן הא' - י"ל שחטא הבעל והמיתה ע"י השור הם בזה אחר זה ככל סיבה ומסובב. באופן הב' - בעת שהשור ממית אז חוטא הבעל (בדוגמת שחצירו נקרא ידו) (ועפי"ז נפ"מ לדינא - באם מכר השור ע"מ שבאם ימית השור - תחול המכירה תיכף ולפני ההמתה).
לשון הש"ס (סנהדרין ט"ו:) אי אתה הורגו על רציחת שורו. יל"פ לב' האופנים: לאופן הא' - כי ברגע הרציחה - כבר אין הסיבה ( הבעל ), רק השור. לאופן הב' - כי כל ענין הרציחה הוא אך ורק של השור , וכל שייכות הבעל הוא רק בזה שזהו "שורו". והנה אם נאמר כאופן הב' - מובן יותר שאין להפריד בין דיון ע"ד השור והדיוק דבעליו - כיון שחטא שניהם היא בפעולה אחת .
וי"ל דבכלל אופן הב' מחוור יותר:
א) לאופן הא' ל"ל קרא בתם דבעל השור נקי ומפרש ר"י בן בתירא נקי מידי שמים - דפשיטא, מאי הוה לי' למיעבד בתם? (וי"ל דבזה פליגי חבריו דר"י בן בתירא עליו).
ב) לדעת הרגצובי (ראה צפנת פענח לסנהדרין ט"ו:) כ"מ בש"ס שם (ודלא כהנ"ל).
והנה לכאו' י"ל דהירושלמי פליג על הבבלי (שלא מזכיר גזה"כ בנדו"ד) שהרי פירש דגזה"כ שיסקל השור (פ"א סה"א וסה"ב), ובפרט לפי הפני משה בירושלמי דגזה"כ שיסקל בכ"ג כמיתת בעלים . אבל לא זכיתי להבין פירוש הפני משה - דא"כ העיקר (דמיתתו בכ"ג) חסר בירושלמי! ועוד לפירושו - הא דהשור נסקל גם טפל לא הוי, דמאי נפק"מ לשאלתו שם (וע"ד זה אינו מובן פירושו לפ"ז "ממון" הוא דהכוונה שנדון בג').
ולפענ"ד פירוש הירושלמי כפשוטו: שור הנסקל כולו ממון הוא - וממון בכל התורה "ענשו" ג"כ ממון שלם ישלם, אלא דכאן גזה"כ דממון זה ענשו שיסקל ג"כ (נוסף על נתינת הכסף דבעל הממון) וא"כ אין לחלק בין ממון (הגורם לסקילה) לממון (הגורם נתינת הכסף). ועפי"ז יומתק ל' הירושלמי שור הנסקל כולו ממון הוא, וק"ל.
ועדיין צ"ע דגם גזה"כ זו לא נזכרה בבבלי. וי"ל דלשטתייהו אזלי. בבבלי מפרש (כנ"ל) וגם בעליו יומת ביד"ש, (וא"כ 1) אין כולו ממון - דלפי' זה - "כולו" צריך להיות כולל גם הבעלים 2) שאלת ר"א בירושלמי: מהו שיתן כסף בג' מעיקרא ליתא, כיון דהכסף בא כתוצאה ממיתה ביד"ש) בסוגייתן בירושלמי י"ל דס"ל דהלכה עוקרת את המקרא כאן (וכדפי' באדרת אלי' למשפטים) וכמש"פ (פ"א ה"ב) בעליו יומת וכו' שותף לסטים כליסטים וכו' א"ל דחית בקנה וכו' א"ל כמיתת הבעלים כך כו' - ודו"ק, ואין כאן מיתה כלל וכולו ממון.
ויש להאריך בכ"ז ואין כאן מקומו.

הי' קס"ד לכאורה לבאר הא דמיתת שור כמיתת בעלים (אף דזהו ד"מ וזה ד"נ):
1) ע"פ המכילתא שמ"ר הובאו ברמב"ן (לבשלח יז, ג) (מילתא בטעמא ולא גזה"כ) דבהמתו של אדם היא חייו דזהו הלכה ולא אגדה (ראה שו"ע אדמוה"ז חאו"ח סרמ"ח סי"ג ממג"א שם). (ול"ק מכמה דיני שורו שאינם כדיני נפשות - כי בקרא דהמכיל' הוא: להמית גו' את מקני, מיתת שור דוקא) - אלא שזה אינו, דא"כ הי' צריך להיות כדנ"פ גם בדיני מיתת שורו שמסרו לשומרים וכיוצ"ב.
2) כדברי הרשב"א לב"ק קיב, א - באם נפרשם כפשוטם (כמובא במכתב המצורף בזה) שמיתת השור - מצד עצמו נחשבת כמיתת בעלים (ולא מפני שהוא חיי הבעל, כנ"ל במכילתא). אלא שלפ"ז - זהו גזה"כ שאין כמוהו ולא דומה לה. אין כל הסברה לזה שרק דין כ"ג יש בשור הנסקל ולא שאר עשרה דברים שבד"נ (סנה' לו, ב);
בפרט צע"ג עפ"ז בלשון רש"י שם ד"ה לא: דהיקש אתא לעיקר הדין ותחילתו כו' מה לנו לחוס על שור כו', דשקו"ט כזו שייכת לענין שבסברא ולא בגזה"כ (ובפרט גזה"כ כהנ"ל - שהוא היפך הסברא). ולכן פירשתי דמיתת השור הוי דנ"פ מפני שאז "גם בעליו יומת" ולא מצד עצמו (וככתבי מאז) וגם בהרשב"א יל"פ כן.
